{"id":784,"date":"2019-04-07T10:28:45","date_gmt":"2019-04-07T10:28:45","guid":{"rendered":"https:\/\/adwokatholowczyc.pl\/?p=784"},"modified":"2026-02-07T16:53:35","modified_gmt":"2026-02-07T15:53:35","slug":"separacja-na-czym-polega","status":"publish","type":"post","link":"https:\/\/adwokatholowczyc.pl\/en\/separacja-na-czym-polega\/","title":{"rendered":"Separation - what does it consist of?"},"content":{"rendered":"<p><strong>What is the difference between separation and divorce?<\/strong><\/p>\n\n\n\n<p>When, for various reasons, the bond between spouses completely disappears, divorce may seem the obvious solution for many. Sometimes, however, the parties want to see if they really don't want to live together anymore. Or sometimes, for example, for religious reasons, they do not agree to the cessation of the marriage. In such a situation, it is possible to declare a separation.<\/p>\n\n\n\n<p>Separation was introduced into Polish legislation in 1999. Legal separation should be distinguished from de facto separation, during which all the effects of marriage continue. Moreover, factual separation often precedes legal separation. According to Article 611 of the Family and Guardianship Code, three prerequisites-one positive and two negative-are necessary for a legal separation. First of all, there must be a complete breakdown of marriage between the spouses. However, it does not have to be permanent, which is a prerequisite for the pronouncement of divorce. The decree of separation must not be contrary to the welfare of minor children and the principles of social intercourse. If the parties do not have minor children, the court may pronounce separation on the basis of a consensual request of the spouses.<\/p>\n\n\n\n<p>The defendant in a separation case may also demand either separation or divorce. If one of the spouses demands separation and the other demands divorce and it is justified-the court will pronounce a divorce. If, on the other hand, the pronouncement of divorce is not acceptable, for example, due to the welfare of minor children-the court will pronounce a separation. As in the case of divorce, in the case of separation the court may refrain from deciding on fault at the request of the parties, determine that one of the spouses is guilty of marital breakdown or determine that both spouses are guilty of marital breakdown. The causes of decomposition of marriage can be divided into culpable, which include abandonment of the spouse, alcoholism, infidelity, refusal of sexual intercourse, and non-culpable - illness, difference of character. There are also indirect causes, among which the most common are infertility, inappropriate behavior of the spouse's family, defects in the statement of intent during the marriage. A guilty verdict affects the determination of guilt in a later, eventual divorce judgment. This is because the divorce court is bound by the judgment of guilt contained in a final judgment of separation, and this binding applies to the state of affairs existing at the time of the closing of the hearing in the separation case. On the other hand, it independently evaluates the circumstances that have already occurred after the separation judgment, which may affect the imputation of guilt at divorce. In a judgment declaring separation, the court also decides on parental authority over the joint minor child of both spouses and contact between the parents and the child, and decides how much each spouse is obliged to pay for the maintenance and upbringing of the child. The court may entrust the exercise of parental authority to one parent, limiting the parental authority of the other to certain duties and powers in relation to the person of the child, or leave parental authority to both parents if they present a parenting agreement. It should be remembered that siblings should grow up together. A decree of separation creates a property separation between the spouses.<\/p>\n\n\n\n<p>Separation cases are heard before the district court in whose district the spouses had their last common domicile, if at least one of them still has his or her domicile or habitual residence in that district (for example, if the last common domicile of the parties was Pozna\u0144, the district court in Pozna\u0144 will have jurisdiction). In the absence of such a basis, only the court of the defendant's domicile has jurisdiction, and if there is no such basis either - the court of the plaintiff's domicile. A fixed fee in the amount of PLN 600 is charged on a suit for separation. The case for separation may be litigated in a procedural or nonprocedural mode. Non-procedural mode is allowed only if the parties do not have minor children in common. Consequently- the court then does not rule on parental authority, contact with children and alimony for joint minor children, but also on guilt. The fee for such an application is PLN 100.<\/p>\n\n\n\n<p>Separated spouses cannot be treated as persons who have been divorced- unless specifically indicated in the law. First of all, they may not marry another person. If equity requires it, they are obliged to assist each other. There is an obligation of alimony between separated spouses. The pronouncement of separation also has consequences in inheritance law-spouses who remain separated do not inherit from each other by law. What is debatable, however, is whether a duty of fidelity remains between spouses after a ruling of separation. On the one hand, they are no longer bound by Article 23 of the Family and Guardianship Code, according to which they are obliged to live together, to help each other and be faithful to each other, and to work together for the good of the family they have established through their union. On the other hand- very often the purpose of separation is to save the marriage, and the duty of fidelity is, it would seem, necessary for the realization of this goal.<\/p>\n\n\n\n<p>The abolition of the separation requires the intervention of the court-a mere agreement of the spouses is not enough. Once the separation is lifted, its effects cease. The abolition of separation creates a statutory property regime between the spouses, although it is possible to maintain property separation. When abolishing the separation, the court ex officio decides on parental authority over the joint minor child of the spouses.<\/p>\n\n\n\n<p><\/p>","protected":false},"excerpt":{"rendered":"<p>Not every marital breakdown must lead to divorce.
